Without prejudice to what is necessary to write by law below, often complying with boring bureaucratic and administrative terms, we would like to underline that for us the relationship with the customer is absolutely friendly and confidential. For over 20 years we have been working every day to guarantee our customers the best possible shopping and consumption experience.
Therefore, for us there are no problems (which we prevent if possible) but solutions that we always apply to ensure that our customer is satisfied and happy!
All those that can be problems (broken delivery, missing parcels, courier mistakes and more) are just opportunities for us to demonstrate to the customer that we bend over backwards: indeed, we often go further in solving them because we remedy the problems by creating customer a greater benefit than the damage/inconvenience suffered and above all - what matters most to us - we demonstrate that we are serious and reliable.
This is the philosophy that has characterized our family business for over 20 years and which has allowed us to have over 40,000 satisfied families today.
General provisions
These general conditions of sale (hereinafter, "General Conditions") apply to all sales of products (hereinafter, "Products " or "Product") purchased through the website www.laportadeisapori.it (hereinafter, "Site") for deliveries to be made exclusively in Italy (excluding the municipality of Livigno ).
The contracts concluded with Fratelli Baiardo S.N.C. di Baiardo Gian Luigi and Claudio ("La Porta dei Sapori" trademark) through the Website are governed by Italian law and, in particular, by Legislative Decree 6 September 2005, n. 206 ("Consumer Code") with reference to articles 50 to 68 relating to distance selling and by Legislative Decree 9 April 2003, n. 70 (hereinafter, "E-commerce Decree").
The use of the distance selling service described in these General Conditions is open to both private consumers (hereinafter, "Clients" or the "Client" or "the buyer"), understood as natural persons acting for personal purposes, or professional operators acting for commercial, entrepreneurial or professional purposes.
In general, a private individual does not need an invoice as to ask for assistance and a guarantee it is sufficient to keep the transport document that you receive together with the delivery of the purchased products.
Professional operators who compulsorily require the issuance of an invoice can select the appropriate option during the purchase procedure.
Biaardo Brothers S.N.C. di Baiardo Gian Luigi e Claudio ("La Porta dei Sapori" brand) reserves the right to modify the General Conditions at any time without notice. However, the changes will have no value in relation to purchase orders that have been sent before the publication of the changes on the Site.
The Customer is required to carefully read these General Conditions which have been made available to him on the Site, in order to allow them to be stored and reproduced by the Customer pursuant to art. 12 of Legislative Decree 9 April 2003, n. 70. By validating the purchase order, the buyer expresses acceptance of the General Conditions and consent for all communications to be sent and received by e-mail. The buyer is responsible for the correctness of the e-mail address and for all the information entered when the order is issued.
For any question regarding the General Conditions, for any complaint or communication of withdrawal, cancellation of the order, return and refund, it is necessary to send a communication to the address servizioclienti@laportadeisaporiit
The information relating to the Products that can be sold remotely through the Site is available, with the relative product codes, on the Site. The photographs illustrating the products are provided for information only. The differences between the photographs and the products can only be minimal differences and do not concern the essential characteristics of the products. Fratelli Baiardo S.N.C. – La Porta dei Sapori reserves the right to modify the packaging and labeling of the products.
Product information is provided in compliance with articles 52 and 53 of the Consumer Code. The products are in most cases available in stock. In the event that, having received the order, the product is not available due to an error updating the Site, the Customer will receive prompt notification and can decide whether to wait for the set times or request a refund (as provided below).
The prices relating to each product are those specifically indicated on the Site at the time of their selection for purchase. The price of the product and any additional cost related to the purchase will also be indicated, in a clear and understandable way, on the purchase order summary. Before completing the purchase process and sending the order, the Customer will be asked to confirm the order summary.
The promotions on the Site are valid while stocks last and within the indicated purchase limits. The promotional products may be delivered in promotional packages other than those published on the Site. No replacement or return is possible in relation to any products received free of charge.
The prices of the products are inclusive of taxes, duties and the WEEE eco-contribution. All prices are expressed in Euros.
The prices of the products do not include shipping costs which will be added to the total amount of the order based on the rates published on the Site at the time the order is sent; they will be clearly indicated in a single item in the order summary which you will have to confirm before sending.
Biaardo Brothers S.N.C. – La Porta dei Sapori reserves the right to change its prices and shipping costs at any time, by publishing the new amounts on its website: these changes will only be effective for orders confirmed after their publication on the Website.
Biaardo Brothers S.N.C. – La Porta dei Sapori reserves the right to cancel an order in the event of an obvious error in the calculation system or in the data. In this case, Fratelli Baiardo S.N.C. – La Porta dei Sapori will provide timely communication to the e-mail address or telephone number indicated at the time of registration, refunding the Customer any amount already paid.
During registration, the Customer will be asked to indicate a valid e-mail address and password, his personal information, residence, a telephone number and anything else that identifies the Customer for purposes required by the contract
The Customer will also be asked to indicate the place where the products must be delivered. It will be the Customer's responsibility to keep the data provided for the purchase updated and to promptly communicate to Fratelli Baiardo S.N.C. – La Porta dei Sapori any changes.

The Customer is solely responsible for the truthfulness, correctness and adequacy of the data provided. It is strictly forbidden to enter false and/or invented and/or fictitious data or relating to third parties.
Fratelli Baiardo S.N.C. di Baiardo Gian Luigi e Claudio ("La Porta dei Sapori" brand) reserves the right to legally prosecute any violation and any fraudulent action against it and/or to the detriment of other consumers.
No responsibility can be charged to Fratelli Baiardo S.N.C. di Baiardo Gian Luigi e Claudio ("La Porta dei Sapori" brand) for any errors contained in the tax documents sent to the Customer and attributable to errors or omissions in the data provided by the Customer at the time of registration.
The Customer will be solely and exclusively responsible for:
- keeping the password secret; no responsibility can be attributed to Fratelli Baiardo S.N.C. di Baiardo Gian Luigi e Claudio ("La Porta dei Sapori" trademark) in the event of use of the password by third parties;
- of the illegitimate use of your password by unauthorized third parties; if the Customer suspects that another user knows his password, he is requested to immediately inform Fratelli Baiardo S.N.C. of Baiardo Gian Luigi and Claudio ("La Porta dei Sapori" trademark) at the above address.
It is understood that the data provided during registration and any other data provided by the Customer during the purchase procedure will be processed by Fratelli Baiardo S.N.C. di Baiardo Gian Luigi e Claudio ("La Porta dei Sapori" brand) in full compliance with the rules set out in EU Regulation 679/2016 on data protection (more commonly known as "GDPR"). In this regard, please carefully read the Privacy Policy.
The essential characteristics and prices of the Products are shown in the offer relating to each Product. If the customer has never made any purchases on the website www.laportadeisapori.it, he will be asked to enter all the data, otherwise he will just need to log in by entering the access keys (email address and password) that have been sent by the system following the first registration or it will also be possible to purchase as a Guest.
To purchase the Products, the Client must follow the instructions on the Site and place the Product in the appropriate "cart"; in this way the order form will begin to be completed in electronic format.
Before submitting his purchase order, the Customer will have the possibility to correct any data entry errors following the appropriate modification procedure contained in the Site.
In particular, the Customer has the right to modify the quantity of Products he intends to purchase, by adding or eliminating one or more Products from the "cart".
Once the choice of products has been completed and, after having read the General Conditions, with particular reference to the contribution for delivery costs the operating methods of Right of Withdrawal and the Privacy Policy, the Customer must select the desired payment method and choose the "Order Confirmation"
The purchase order sent and confirmed to Fratelli Baiardo S.N.C. di Baiardo Gian Luigi e Claudio ("La Porta dei Sapori" brand) will be valid as irrevocable purchase offer.
By sending the order, the Customer acknowledges and declares to have read all the information provided to him during the purchase procedure and to fully accept the General Conditions which he undertakes to print and keep once the procedure has been completed purchase order "online".
All purchase orders transmitted via the Site must be complete in all their parts and must contain the elements necessary for the exact identification of the person placing the order (Customer), the products ordered, the their quantity, and the place where the delivery will take place.
The order number provided automatically by e-mail has only internal value and does not imply acceptance of the order by Fratelli Baiardo S.N.C. of Baiardo Gian Luigi and Claudio (trademark "La Porta dei Sapori") who also:
Biaardo Brothers S.N.C. di Baiardo Gian Luigi e Claudio ("La Porta dei Sapori" brand) accepts payments made by Credit Card, PayPal, Amazon Pay, Cash on Delivery, Bank Transfer.
By filling in the appropriate space on the Site, the Customer authorizes Fratelli Baiardo S.N.C. di Baiardo Gian Luigi and Claudio ("La Porta dei Sapori" brand) to charge the total amount of the order, shipping costs included.
Fratelli Baiardo S.N.C. di Baiardo Gian Luigi e Claudio ("La Porta dei Sapori" brand) will prepare and deliver the Products when the credit card issuer has authorized their use for payment of the Products ordered.
If you do not receive this authorization, Fratelli Baiardo S.N.C. di Baiardo Gian Luigi and Claudio ("La Porta dei Sapori" brand) will inform the customer.
Fratelli Baiardo S.N.C. di Baiardo Gian Luigi e Claudio ("La Porta dei Sapori" brand) reserves the right to verify the identity of the credit card holder, requesting suitable documentation.
In compliance with the provisions of art. 53 of the Consumer Code, the Customer receives, at the time of execution of the contract, by email, the confirmation of receipt of the purchase order sent by the Customer.
The sales contract is understood to be concluded when it is sent by Fratelli Baiardo SN.C. di Baiardo Gian Luigi e Claudio ("La Porta dei Sapori" trademark) of the order confirmation to the e-mail address indicated during registration.
By purchasing on the Site, the Customer accepts that all notifications and communications relating to orders are made by Fratelli Baiardo S.N.C. di Baiardo Gian Luigi e Claudio ("La Porta dei Sapori" trademark) by e-mail to the address communicated for this purpose when registering the user account referred to in the previous point.
The Customer enjoys the legal guarantee pursuant to the provisions of Part IV Title III Chapter I (from articles 128 to 135) of Legislative Decree 6 September 2005 n. 206 ("Consumer Code") in relation to any lack of conformity of the product existing at the time of delivery.
Where, at the time of delivery of the product, the Customer becomes aware of differences or any defects in the packaging of the products, must immediately report it to the carrier and sign the delivery document "with reserve". Any lack of conformity of the Product must be reported to Fratelli Baiardo S.N.C. – La Porta dei Sapori according to the methods set out in article 132 of the Consumer Code to the e-mail address ordiniprodotti@laportadeisapori.it
The warranty applies exclusively to faults/breakages which occur despite normal use of the product.
The warranty does not apply in cases of negligence or carelessness in the use and maintenance of the product.
In any case the warranty term is two years and starts from the delivery date, resulting from the receipt certifying the purchase and delivery as better indicated on the page relating to the Warranty conditions.
Biaardo Brothers S.N.C. di Baiardo Gian Luigi e Claudio ("La Porta dei Sapori" brand) will not be held responsible for failures or delays in the execution of the order in the event that such failures or delays are caused by impediments such as work interruptions, union unrest, suspension of transport and any other cause that may integrate an impediment due to force majeure or unforeseeable circumstances.
The sales contract is subject to these General Conditions and regulated by Italian law
For civil disputes falling within the scope of Legislative Decree 6 September 2005 , n. 206 (Consumer Code) the judge of the final customer's place of residence will have exclusive jurisdiction, provided that it is located in Italy.
In all other cases, the Court of Imperia will have exclusive jurisdiction with the exclusion of any other alternative jurisdiction.
